NexClix, Inc. (“NexClix,” “we,” “our,” or “us”) is a company headquartered in Atlanta, Georgia. We provide goods and services to customers across the public and private sectors.
This Privacy Policy explains how we collect, use, store, protect, and share information about individuals who visit our website (nexclix.com), contact us by phone or email, or consent to receive SMS/text message communications from us. It also describes the rights you have with respect to your personal information.
By using our website or providing your contact information — including your mobile phone number — you acknowledge that you have read and understood this Privacy Policy.
SMS Notice: NexClix uses a third-party messaging platform to send SMS/text messages. No mobile phone numbers or SMS consent data collected by NexClix will ever be shared with third parties for their own marketing purposes. Message and data rates may apply.

Data We Collect
2.1 Information You Provide Directly
- Identity information: Full name, job title, company or organization name
- Contact information: Business email address, phone number, mobile/cell phone number, mailing address
- Communication content: Messages, inquiries, or documents you send us via email, web forms, or SMS
- SMS consent: Your expressed opt-in consent to receive text messages, the date and time of that consent, and the specific program(s) you consented to
2.2 Information Collected Automatically
- Device and browser data: IP address, browser type, operating system, device identifiers
- Usage data: Pages visited, time spent, referring URL, and navigation paths on nexclix.com
- Cookies: Session cookies for site functionality (see Section 10)
2.3 Information from Third Parties
We may receive limited contact information from public directories, procurement databases, and professional networking platforms in connection with our business activities. We do not purchase consumer marketing lists.

How We Use Your Data
- Business operations: Responding to inquiries, providing quotes, delivering goods and services, and managing vendor or partner relationships
- SMS communications: Sending transactional and campaign-related text messages to individuals who have explicitly opted in (see Section 4)
- Compliance and legal obligations: Meeting requirements under the TCPA, CTIA guidelines, and applicable federal and state law
- Website improvement: Analyzing aggregate usage patterns to improve usability and content
- Security: Detecting, investigating, and preventing fraud, unauthorized access, or illegal activities
- Contractual performance: Fulfilling obligations under agreements with our public and private sector customers
NexClix does not use your personal information for targeted advertising, third-party remarketing, or resale to data brokers or marketing networks.

SMS / Text Messaging
4.1 SMS Program Description
NexClix operates two SMS messaging programs via an A2P 10DLC-registered communications platform:
- Customer Campaign Program: Targeted outreach messages to prospective and existing customers regarding our goods and services, announcements, opportunities, and project updates.
- Vendor & Partner Program: Operational communications to vendors and partners working on or being considered for NexClix engagements, including scheduling, documentation requests, and status updates.
4.2 How We Obtain Your Consent (Opt-In)
NexClix will only send you SMS messages if you have given us your prior express written consent. Consent may be obtained through:
- Completing a web form on nexclix.com with a clearly displayed opt-in checkbox and required CTIA/TCPA disclosure language
- Signing a written agreement that includes an SMS consent provision
- Verbally confirming consent during a documented business call
The following disclosure will appear on any opt-in form:
“By providing your mobile number and checking this box, you consent to receive recurring automated text messages from NexClix, Inc. at the number provided. Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP. For help, reply HELP or contact info@nexclix.com. Consent is not a condition of any purchase or service.”
4.3 Message Frequency

4.4 Message and Data Rates
Standard message and data rates may apply depending on your carrier plan. NexClix does not charge recipients for SMS messages. Consult your wireless carrier for applicable fees.
4.5 How to Opt Out — STOP
You may withdraw consent and stop receiving SMS messages at any time by replying with any of the following keywords:
You will receive a single confirmation message and no further messages will be sent. You may also opt out by emailing info@nexclix.com with “SMS OPT-OUT” in the subject line, or calling (877) 464-5674. Opt-out requests are processed within 10 business days.
4.6 How to Get Help — HELP
Reply HELP to any NexClix message or email info@nexclix.com for SMS program information, including how to opt out.
4.7 Supported Carriers
Supported major carriers include AT&T, T-Mobile, Verizon, Boost Mobile, Cricket, Metro by T-Mobile, U.S. Cellular, and other regional carriers. Carrier support may vary.
4.8 Consent Records
NexClix maintains records of all SMS consents — including date, time, method, program consented to, and phone number — for a minimum of five (5) years in compliance with TCPA requirements.

Third-Party Sharing — SMS Data
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. This is a firm and unconditional commitment by NexClix, Inc.
- Mobile phone numbers collected for SMS consent will not be sold, rented, traded, or shared with any third party for their own marketing use
- SMS opt-in data and consent records are not shared with any data brokers, marketing platforms, or advertising networks
- The only third party that receives your mobile number in connection with SMS delivery is our communications platform provider, acting as a data processor under a written data processing agreement

Disclosure of Information
NexClix does not sell personal information. We may share your information in the following limited circumstances:
6.1 Service Providers
We engage vetted third-party service providers who assist us in operating our business, including providers of communications, website hosting, and business productivity services. All service providers are bound by written agreements limiting use of your data to the services provided on our behalf.
6.2 Legal and Regulatory Obligations
We may disclose personal information when required by law, regulation, legal process, or governmental request — including disclosures required under applicable contractual obligations or law enforcement requests with proper legal authority.
6.3 Business Transfers
In the event of a merger, acquisition, or asset sale, personal information may be transferred as part of that transaction. We will provide advance notice before such a transfer occurs and will ensure continued privacy protections.

Data Security
NexClix implements administrative, technical, and physical safeguards consistent with industry best practices:
- Encryption of data in transit (TLS 1.2 or higher) and at rest
- Access controls and role-based permissions limiting data access to authorized personnel only
- Multi-factor authentication (MFA) for all systems containing personal data
- Regular security awareness training for all staff
- Periodic vulnerability assessments and security reviews
No method of transmission over the internet or electronic storage is 100% secure. In the event of a data breach that materially affects you, we will notify you as required by applicable law.

After the applicable retention period, personal information is securely deleted or anonymized.

- Right to deletion: Request deletion of your personal information, subject to legal retention requirements
- Right to opt out of SMS: Withdraw consent to receive text messages at any time (see Section 4.5)
- Right to non-discrimination: We will not discriminate against you for exercising any privacy rights
To exercise any of these rights, submit a written request to info@nexclix.com with the subject line “Privacy Rights Request.” We will respond within 45 days.

Cookies
NexClix uses only essential session cookies required for basic website functionality. We do not use tracking cookies, advertising pixels, or third-party analytics cookies that identify individual visitors. Session cookies are temporary and are deleted when you close your browser.

Third-Party Links
Our website may contain links to external websites, government portals, and partner resources. NexClix is not responsible for the privacy practices or content of third-party websites. We encourage you to review the privacy policy of any external site before providing personal information.

Children's Privacy
NexClix's website and services are directed exclusively to business professionals and adult users. We do not knowingly collect personal information from individuals under the age of 13. NexClix reserves the right to update this Privacy Policy at any time. When we make material changes, we will update the “Last Updated” date at the top of this page and, where appropriate, notify SMS subscribers. Your continued use of our website or SMS program after the effective date constitutes acceptance of the updated policy.
